Public sector employers warned over redundancy legislation compliance
18 February 2011
Looming government cuts mean that public sector employers will have to reduce staff numbers and while this is an emotionally distressing time for all, failure to adhere to relevant employment legislation can make the situation worse.
That is according to Andrea O'Hare, head of personnel and employment law at Citation, who stated that there are many legal aspects to consider when relieving someone of their duties and warned that it is quite a complex task.
"Now more than ever, employers are under increased scrutiny by Employment Tribunals to ensure they are legally compliant when considering redundancies," she said.
Failure to adhere to the law could see public sector bodies suffer a double blow of adverse publicity and large compensation claims.
The UK's public sector will have to find different ways of working as staff numbers are reduced as part of efforts to rein in the country's budget deficit, associated director of policy at the Work Foundation Stephen Overell suggested recently.
